En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. In this work we argue that there is no strong demarcation between pure and applied mathematics. We show this first by stressing non-deductive components within pure mathematics, like axiomatization and theory-building in general. We also stress the “purer” components of applied mathematics, like the theory of the models that are concerned with practical purposes. We further show that some mathematical theories can be viewed through either a pure or applied lens. These different lenses are tied to different communities, which endorse (...) different evaluative standards for theories. We evaluate the distinction between pure and applied mathematics from a late Wittgensteinian perspective. We note that the classical exegesis of the later Wittgenstein’s philosophy of mathematics, due to Maddy, leads to a clear-cut but misguided demarcation. We then turn our attention to a more niche interpretation of Wittgenstein by Dawson, which captures aspects of the aforementioned distinction more accurately. Building on this newer, maverick interpretation of the later Wittgenstein’s philosophy of mathematics, and endorsing an extended notion of meaning as use which includes social, mundane uses, we elaborate a fuzzy, but more realistic, demarcation. This demarcation, relying on family resemblance, is based on how direct and intended technical applications are, the kind of evaluative standards featured, and the range of rhetorical purposes at stake. The notion of a correct appreciation of nature, like the one put forward in Carlson’s environmental account, has been rejected by many other authors in the aesthetics of the natural environment. Their critics challenge the idea that only scientific cat- egories can ground the aesthetic appreciation of nature as nature, and they hold that there is not a correct way of appreciating nature. However, they may share with Carlson the idea of correctness under an objectivist paradigm of aesthetic appreciation, according (...) to which correctness means the adequation of the experi- ence to properties of the object. My aim in the article is to claim that it is necessary to endorse an aesthetic standard of correctness that takes into consideration the subjective character of aesthetic appreciation. An aesthetic standard of correct- ness implies universal assent, or validity for everyone in Kantian terms, in place of an objectivist notion. This notion of correctness permits the inclusion of expressive perception of nature as an essential form of aesthetic appreciation. (shrink)

The Uniform Determination of Death Act (UDDA) provides that “an individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead.” We show that the UDDA contains two conflicting interpretations of the phrase “cessation of functions.” By one interpretation, what matters for the determination of death is the cessation of spontaneous functions only, regardless of their generation by artificial means. By the (...) other, what matters is the cessation of both spontaneous and artificially supported functions. Because each UDDA criterion uses a different interpretation, the law is conceptually inconsistent. A single consistent interpretation would lead to the conclusion that conscious individuals whose respiratory and circulatory functions are artificially supported are actually dead, or that individuals whose brain is entirely and irreversibly destroyed may be alive. The intuitive distinction between natural and unnatural properties (e.g., green vs. grue) informs our theorizing not only in fundamental physics, but also in non-fundamental domains. This paper develops a reductive account of this broad notion of naturalness that covers non-fundamental properties: for a property to be natural, I propose, is for it to figure in a law of nature. After motivating the account, I defend it from a potential circularity charge. I argue that a suitably broad notion of lawhood can (...) be defined independently of naturalness, if we help ourselves to the notion of a fundamental physical property. I end by showing how the notions of naturalness and lawhood that my account delivers help illuminate a number of other important philosophical notions, like causation, reference/meaning, and rational induction. Laura Specker Sullivan (2022) makes a fairly compelling case for the value of the perspectives of Buddhist practitioners in neuroethics. In this study, Tibetan Buddhist monks have been asked, among other things, whether consciousness, in brain-injured patients in a minimally conscious state, entails a duty to preserve life. In our view, some of the participants’ responses could be used to inform the bioethical debate on death determination.

This chapter aims to examine the configuration of the sharing economy in the United Kingdom. The chapter provides an examination of the key opportunities and challenges that this socio-economic model generates in the country. It includes an account of different sharing economy initiatives in the United Kingdom, including crowdfunding projects, tool libraries, timesharing banks, men’s sheds, and shared workspaces, commercial sharing economy services, micro-libraries, community-gardening projects, and paid online peer-to-peer accommodation. Increased consumer choice and economic benefits derived from an extended (...) economy around the sharing economy are identified as key opportunities. Key challenges relate to policymaking and taxation of businesses and participants in the sharing economy, as well as the wider enforcement of health and safety regulations and the impact that the recent pandemic is having on the industry. The chapter also provides an examination of the latest developments and regulations in this area. In addition, the chapter identifies the most pressing issues and possible future directions of research in this context. (shrink)

Pérez Carballo adopts an epistemic utility theory picture of epistemic norms where epistemic utility functions measure the value of degrees of belief, and rationality consists in maximizing expected epistemic utility. Within this framework he seeks to show that we can make sense of the intuitive idea that some true beliefs—say true beliefs about botany—are more valuable than other true beliefs—say true beliefs about the precise number of plants in North Dakota. To do so, however, Pérez Carballo argues that (...) we must think of the value of epistemic states as consisting in more than simply accuracy. In this chapter, we will summarize recent empirical results highlighting how different groups of people solve pure coordination games. Such games are traditionally studied in behavioural economics, where two people need to coordinate without communicating with each other. Our results suggest that coordination choices vary across groups of people, and that people can adapt flexibly to these differences in order to coordinate between groups. We propose that pure coordination games are a useful empirical platform for studying aspects of mindshaping. Drawing (...) on existing psychological literature on alignment during interactions, we suggest that experience of successful interaction leads people to develop aligned intuitions about what is relevant and appropriate that support coordination when interaction and communication is not possible. Consistent with arguments made in the literature on mindshaping we believe that such alignment is more important for coordination than mindreading inferences about mental states, and indeed that mindreading is instead a form of coordination behaviour that is dependent upon intuitive alignment. The debate regarding the nature of joint action has come to a stalemate due to a dependence on intuitional methods. Normativists, such as Margaret Gilbert, argue that action-relative normative relations are inherent in joint action, while non-normativists, such as Michael Bratman, claim that there are minimal cases of joint action without normative relations. In this work, we describe the first experimental examinations of these intuitions, and report the results of six studies that weigh in favor of the normativist paradigm. Some arguments against David Lewis’s modal realism seek to exploit apparent inconsistencies between it and anthropic reasoning. A recent argument, in particular, seeks to exploit an inconsistency between modal realism and typicality anthropic premises, premises common in the literature on physical multiverses, to the effect that observers who are like human observers in certain respects must be typical in the relevant multiverse. Here I argue that typicality premises are not applicable to the description of Lewis’s metaphysical multiverse, where the proportions (...) of metaphysically possible observers possessing the pertinent properties can be independently established by metaphysical reasoning. However, other kinds of reasonable anthropic premises can be seen to be consistent with and usable within modal realism. (shrink)

This essay proposes a reductive account of robust macro-regularities. On the view proposed, regularities can earn their elite scientific status by featuring in good summaries of restricted regions in the space of physical possibilities: our “modal neighborhoods.” I argue that this view vindicates “nomic foundationalism”, while doing justice to the practice of invoking physically contingent generalizations in higher-level explanations. Moreover, the view suggests an explanation for the particular significance of robust macro-regularities: we rely on summaries of our modal neighborhoods when (...) reasoning hypothetically about “agentially accessible” possibilities. Sacrificial dilemmas such as the trolley problem play an important role in experimental philosophy (x-phi). But it is increasingly argued that, since we are not likely to encounter runaway trolleys in our daily life, the usefulness of such thought experiments for understanding moral judgments in more ecologically valid contexts may be limited. However, similar sacrificial dilemmas are experienced in real life by animal research decision makers. As part of their job, they must make decisions about the suffering, and often the (...) death, of many non-human animals. For this reason, a context-specific investigation of so-called “3R dilemmas” (i.e., dilemmas where there is a conflict between the principles of replacement, reduction, and refinement of the use of animals in research) is essential to improve the situation of both non-human animals and human stakeholders. An approach well suited for such investigation is experimental philosophical bioethics (“bioxphi”), which draws on methods similar to x-phi to probe more realistic, practical scenarios with an eye to informing normative debates and ethical policy. In this article, we argue for a need to investigate 3R dilemmas among professional decision-makers using the tools of bioxphi. In a first step, we define 3R dilemmas and discuss previous investigations of professionals’ attitudes in such cases. In a second step, we show how bioxphi is a promising method to investigate the whys and hows of professional decision-making in 3R dilemmas. In a last step, we provide a bioxphi template for 3R dilemmas, give recommendations on its use, explore the normative relevance of data collected by such means, and discuss important limitations. Guido Löhr's recent article makes several insightful and productive suggestions about how to proceed with the empirical study of collective action. However, their critique of the conclusions drawn in Gomez-Lavin & Rachar (2022) is undermined by some issues with the interpretation of the debate and paper. This discussion article clears up those issues, presents new findings from experiments developed in response to Löhr's critiques, reflects on the role of experimental research in the development and refinement of philosophical theories, and adds (...) to Löhr's suggestions about the path forward. Goal: To assess public knowledge and attitudes towards the family’s role in deceased organ donation in Europe. -/- Methods: A systematic search was conducted in CINHAL, MEDLINE, PAIS Index, Scopus, PsycINFO, and Web of Science on December 15th, 2017. Eligibility criteria were socio-empirical studies conducted in Europe from 2008 to 2017 addressing either knowledge or attitudes by the public towards the consent system, including the involvement of the family in the decision-making process, for post-mortem organ retrieval. Screening and data collection (...) were performed by two or more independent reviewers for each record. -/- Results: Of the 1482 results, 467 studies were assessed in full-text form, and 33 were included in this synthesis. When the deceased has not expressed any preference, a majority of the public support the family's role as a surrogate decision-maker. When the deceased expressly consented, the respondents' answers depend on whether they see themselves as potential donors or as a deceased's next-of-kin. Answers also depend on the relationship between the deceased and the decision-maker(s) within the family, and on their ethnic or cultural background. -/- Conclusions: Public views on the authority of the family in organ donation decision-making require further research. A common conceptual framework and validated well-designed questionnaires are needed for future studies. The findings should be considered in the development of Government policy and guidance regarding the role of families in deceased organ donation. (shrink)

In this paper, I propose to analyse two objections raised by Turner Jr in his paper “On Two Reasons Christian Theologians Should Reject The Intermediate State” in order to show that the intermediate state is an incoherent theory. As we shall see, the two untoward consequences that he mentions do not imply a metaphysical or logical contradiction. Consequently, I shall defend an Intermediate State and I shall propose briefly one metaphysical conception of the human being able to reply to Turner (...) Jr’s objections. (shrink)

Cette étude défend l’idée que, contrairement à l’opinion de Latour sur la nécessité de laisser de côté l’épistémologie pour traiter de tout ce qui a de la valeur pour la science, Mario Bunge a systématiquement construit une épistémologie détaillée et approfondie. La stratégie argumentative consistera à montrer (a) qu’il est faux que nous n’avons jamais été modernes (b) que l’épistémologie est là pour de bon et (c) que Mario Bunge soutient un réalisme scientifique fort, une version du matérialisme, du systémisme (...) et de l’émergentisme, comportant une dimension morale (il existe des valeurs objectives comme la vérité, la paix et la justice qui méritent d’être étudiées). Ensuite, le réalisme de Bunge rejette la neutralité axiologique rendant les scientifiques responsables de leurs actions. Bunge a toujours été moderne et continue à enrichir ses propres positions. From the refusal of some parents to apply some vaccines to their children, in this work we will show that to act properly it is not enough with a good intellectual justification to validate a belief as accurate, it will be necessary to take into account also the systematic actions in relation to which we are constituted, as well as the feelings that accompany those actions. We begin by exposing the notion of belief that Villoro presents from authors such as (...) Braithwaite and Bain. Next, we briefly explain the topic of the justification of beliefs and then articulate it with some of the controversies related to the application of vaccines. Later, we turned to Hume to show the role of imagination in relation to pleasure and pain in decision making. Finally, we present an outline of the discussion about paternalism in the application of vaccines. (shrink)

From the epistemological posture that we present in this work we sustain the following thesis:-That as subjects we constitute the world we live in through one of the possible conceptual frameworks.-Our cognitive and social practices construct the world in a certain manner, which makes us responsible for the way this world is constituted.

In this paper, I defend an epistemological pluralism that moves away from universal and absolute rationality, as well as from a radical and arbitrary relativism, where any criterion is valid for decision making. Such epistemological pluralism maintains that subjects know the world in which they live according to different conceptual schemes. We posit a notion of truth linked to the justification process and practical effectiveness. Then we present the importance of traditional knowledge in the socio-ecological field and relative to complex (...) systems. Finally, we explain the relevance of epistemic equity between traditional and scientific knowledges in order to anticipate consequences and to make decisions less uncertain. (shrink)

This paper uses the tools of experimental philosophy to examine the nature of interpersonal normativity in collective action, focusing on cases of immoral collective action and collective action by friends. The results of our two studies, which expand on recent empirical interventions into longstanding debates in social ontology, demonstrate that according to our everyday judgments there are interpersonal obligations in cases of collective action, even when immoral, and that, while friendship elicits judgments of togetherness, it does not affect the norms (...) of collective action. We also situate these results in the philosophical literature and discuss their consequences for a “pluralism” about sociality. (shrink)

Working memory is a foundational construct of cognitive psychology, where it is thought to be a capacity that enables us to keep information in mind and to use that information to support goal directed behavior. Philosophers have recently employed working memory to explain central cognitive processes, from consciousness to reasoning. In this paper, I show that working memory cannot meet even a minimal account of natural kindhood, as the functions of maintenance and manipulation of information that tie working memory models (...) and theories together do not have a coherent or univocal realizer in the brain. As such, working memory cannot explain central cognition. Rather, I argue that working memory merely redescribes its target phenomenon, and in doing so it obfuscates relevant distinctions amongst the many ways that brains like ours retain and transform information in the service of cognition. While this project ultimately erodes the explanatory role that working memory has played in our understanding of cognition, it simultaneously prompts us to evaluate the function of natural kinds within cognitive science, and signals the need for a productive pessimism to frame our future study of cognitive categories. The boundary problem is related to the binding problem, part of a family of puzzles and phenomenal experiences that theories of consciousness (ToC) must either explain or eliminate. By comparison with the phenomenal binding problem, the boundary problem has received very little scholarly attention since first framed in detail by Rosengard in 1998, despite discussion by Chalmers in his widely cited 2016 work on the combination problem. However, any ToC that addresses the binding problem must also address the boundary problem. (...) The binding problem asks how a unified first person perspective (1PP) can bind experiences across multiple physically distinct activities, whether billions of individual neurons firing or some other underlying phenomenon. To a first approximation, the boundary problem asks why we experience hard boundaries around those unified 1PPs and why the boundaries operate at their apparent spatiotemporal scale. We review recent discussion of the boundary problem, identifying several promising avenues but none that yet address all aspects of the problem. We set out five specific boundary problems to aid precision in future efforts. We also examine electromagnetic (EM) field theories in detail, given their previous success with the binding problem, and introduce a feature with the necessary characteristics to address the boundary problem at a conceptual level. Topological segmentation can, in principle, create exactly the hard boundaries desired, enclosing holistic, frame-invariant units capable of effecting downward causality. The conclusion outlines a programme for testing this concept, describing how it might also differentiate between competing EM ToCs. (shrink)

This paper looks into two Scottish Philosophical Societies of the Eighteenth century: The Philosophical Society of Edinburgh, and the Select Society of Edinburgh. I intend to show that they were planned, constructed, and carried out according to the experimental method of natural philosophy, and that it was this factor that enhanced the influence they had in the development of the country. An examination of the minute books, discourses, abstracts and question lists of these societies will provide enough evidence to support (...) the claim that experimental philosophy and its method were the decisive factors for the developing and huge success of these societies. Working memory is thought to be the psychological capacity that enables us to maintain or manipulate information no longer in our environment for goal-directed action. Recent work argues that working memory is not a so-called natural kind and in turn cannot explain the cognitive processes attributed to it. This paper first clarifies the scope of this earlier critique and argues for a pluralist account of working memory. Under this account, working memory is variously realized by many mechanisms that contribute to (...) the maintenance and manipulation of information across tasks. This view in effect updates one of the earliest pluralist formulations of working memory. Juxtaposing this view against deflationary descriptions allows us to delineate two gradients that help us chart various accounts of working memory and identify their respective theoretical commitments. In turn, we can isolate those accounts that fail to accord with the evidence supporting a pluralist view, and we can begin to rehabilitate working memory as a pluralist, and ultimately more informative, construct. Founders Eva Perez de Vega and Ian Gordon guide the reader through a dynamic selection of projects, each one opening us up to their relationship with the choreography of human and nonhuman forces at play. -/- Born as a retrospective and future-oriented book, it engages philosophical thought with architectural projects located in Europe, Asia, and the US, as well as speculative scenarios (...) that offer an alternative, less human-centric way of practicing architecture. -/- Organised into four parts, each part opens with a philosophical text that acts as an insightful prelude to the topics, questions and reflections posed by each project. Each part concludes with a speculative scenario, where one of the projects is imagined thriving in a future where life is now almost extinct. These are not intended as apocalyptic or even nostalgic scenarios, but rather as affirmative alternatives to the bleak imaginary arising from the world’s current climate crisis. (shrink)

El artículo aborda el problema de la relación entre el ser humano y la técnica en el mundo actual desde una perspectiva filosófica. Volver a la concepción de la filosofía griega permite concebir hoy el quehacer filosófico como un ejercicio vital, sin fracturas entre el pensamiento y la acción. La patente plasticidad del ser humano evidencia la constitutiva apertura que determina su especificidad y, además, columbra la estrecha vinculación entre técnica, creación y cuidado a partir del acontecimiento del habitar. El (...) cuidado no puede tener lugar sin cierta promoción de un ethos cultural centrado en el miramiento, la asistencia y la preocupación por uno mismo y por el Otro. El olvido de la relación entre la creación y el cuidado conduce a un desequilibrio ethopoiético entre la condición ontológica del ser humano, como ser nacido, finito y vulnerable, y el desarrollo tecnológico, impulsado por la digitalización de la vida y el ascendente papel de las nuevas tecnologías en la sociedad. Advertir y remediar dicho desequilibrio supone repensar la originaria relación entre la creación técnica y el cuidado ético, así como la importancia de la ética para la persistencia de lo orgánico. Le titre de cette étude suggère de traiter trois termes, à premier vue, sans aucun lien. En effet, quel peut être le lien entre l’homosexualité et la Bible? Ou celui entre l’homosexualité et les sciences cognitives? Et finalement, quel lien peut-il y avoir entre ces trois termes à première vue juxtaposés? Il y a une réponse à chacune de ces trois questions et nous proposons d’explorer ces réponses dans le cadre de cette étude. According to a bits generation technique, that is, bits can only take a binary value of 0 in the absence of wave function collapse and 1 when wave function collapse occurs, that is, regardless of the value random in which the collapse of the wave function occurs that in the past caused the development of an alternative technique of classic bits to be renounced and remains currently an impossibility in normal science, through series of quantum entanglements, using BCD, EBCDIC or (...) ASCII coding standard in computing, data are teleported surpassing c, from a sender to a receiver, theoretically placed at any distance. This technique is a new discovery with theoretical foundation in the work “Superluminal Data Transmission supported by Quantum Entanglement” (1) by this author, stored, since April 2023, as a preprint, in the ResearchGate, and Philpapers repositories, and pending implementation by communications engineering in a longterm future. In this work it is unequivocally established that the maximum speed c for this type of transmission is false, causing critical break with Relativity. This new technique, unlike the one presented in my previous paper, it is a version much simpler that can be implemented according to the current state of technology, so at present the instantaneous transmission of information can be tested experimentally. Architecture and human-built structures are embedded with speciesist practices of domination over the environment, where humans are considered special and superior to other species. This (hu)man exceptionalism has driven architecture and the built environment to be conceived in opposition to ‘nature’, dominating natural terrains and consequently displacing or instrumentalizing the many other species that are given little to no ethical consideration. This way of intervening in the world is leading to the existential questions that must be posed given our global (...) climate crisis. A reframing of human intervention as ‘built environment’ placed in opposition to the ‘natural environment’ of supposedly passive nature, is urgently needed. The motivation for this paper is rooted in a deep concern for the role of humans in the climate crisis and a realization that architecture as a discipline is complicit in elevating the human category above all other beings in nature. There are biases embedded in the practices and teaching of architecture that need to be interrogated and reflected upon, starting with the role models and ideals that we unwittingly operate within. To contextualize the idea of human exceptionalism in architecture, we will explore deep-seeded ideals in architecture linked to the concept of Rectitude as a form of ‘rightness’ -or correct- mode of intervening in the world, conceptualized by Western men as a human-centric practice distinct from nature-made. Supported by Ecofeminist thought, the aim is to open alternative models for world-building and housing humans on earth living in its sixth extinction. (shrink)

Credentials play an important role in all modern societies, but the analysis of their nature and function has thus far been neglected by social philosophers. We present a view according to which the function of credentials is certify the identity and the institutional status (including the rights) of individuals. More importantly, credentials enable rights-holders to exercise their rights, so that for a particular right to be exercisable the right-holder should possess, carry and sometimes show to an authority (or QR code (...) scanner) a document of a specific kind. Driving licenses, identity cards, passports, boarding passes, library passes, credit cards, ATM cards, health insurance cards are all examples of credentials in this sense. Credentials have in every case a bearer, and the bearer should be able to carry them easily on his or her person. Credentials should also be inspectable – not least because credentials can be forged. The authors analyse several historical and contemporary examples of credentials, focusing on the credentials carried by the pilgrims of the Way of Saint James. (shrink)

Desde la formulación geométrica de la gravedad, según la ecuaciones de Einstein-Grosmann-Hilbert, de noviembre de 1915, como el movimiento geodésico en la variedad semirimenniana de curvatura positiva, espaciotiempo, donde por ausencias de simetrías, no es posible la conservación de la energía-impulso tomando en conjunto los procesos materiales y el del campo geométrico gravitacional, sin embargo, dadas esas simetrías en el espaciotiempo plano de Minkowski, usando el modelo de De Sitter, Einstein linealizando la gravitación, por supuesto, realmente en ausencia de gravedad, (...) en 1916, depuradas de algunos errores matemáticos en 1918, introdujó las "ondas gravitacionales" como perturbaciones en la curvatura del espacio, y en ausencia de saber físicamente qué es el espaciotiempo y filosoficamente en pleito, que previamente en 1936 y definitivamente en 1937, Einstein demostró no existían. Fue por parte de los trabajos surgidos de la dinámica del discurrir académico, desde la perspectiva no de Einstein sino de Weyl, que Bondi, Pirani, Robinson y Trautman, en la década de 1950, posterior al fallecimiento de Einstein, las "ondas gravitacionales" fueron reintroducidas y motivaron que experimentalmente se buscaran. En el 2002, a partir del experimento de VLBI de Sergei Kopeikin fue establecida su supuesta velocidad, sin que obtuviera el reconocimiento unánime de la comunidad de científicos sino diviéndolos. Y fue en febrero de 2016, que la colaboración aLIGO-aVirgo anunciaran haberlas detectado por primera vez. En este trabajo se presenta la historia que conllevo a este supuesto descubrimiento y se plantea que las ondas detectadas son realmente del vacío cuántico en el cual está inmerso todo lo existente, tésis del autor expuesta inmediatamente como respuesta a ese anunció de 2016. Background: Several countries have recently changed their model of consent for organ donation from opt-in to opt-out. We undertook a systematic review to determine public knowledge and attitudes towards these models in Europe. Methods: Six databases were explored between 1 January 2008 and 15 December 2017. We selected empirical studies addressing either knowledge or attitudes towards the systems of consent for deceased organ donation by lay people in Europe, including students. Study selection, data extraction, and quality assessment were conducted by (...) two or more reviewers independently. Findings: Awareness of the consent model was lower in opt-out countries than in opt-in countries. A majority of the public agrees with opt-in, regardless of the law in their own country. There are ambivalent attitudes regarding the opt-out system. The public tend to prefer opt-in and mandatory choice over opt-out when several options are offered. Interpretation: The assumption that people in opt-out countries are aware of the legal requirements to be excluded from the pool of potential donors is not supported by the results of this review. This is a concern, since ignorance hinders people's autonomy regarding organ donation decision-making. Higher awareness of consent model in opt-in countries may reflect greater efforts to inform the public through campaigns to motivate donation. Legal moves towards opt-out are at odds with people's expressed preferences. Main limitations of this review are the lack of data from some countries, study population heterogeneity, and methodological shortcomings. (shrink)

La performatividad es un concepto relativamente reciente. J. L. Austin lo introdujo en la filosofía del lenguaje en la década de los cincuenta para designar aquellas expresiones que, en las circunstancias apropiadas, hacen justo aquello que dicen que hacen (como cuando alguien exclama «te lo prometo»). Desde entonces ha sido sometido a intensos procesos de discusión, crítica y resignificación que lo han conducido a terrenos de reflexión teórica, filosófica y política progresivamente alejados de su contexto originario. Este libro explora, entre (...) todos los trayectos posibles en el interior de estos debates, el modo en que la preocupación de Austin por comprender cómo hacemos cosas con palabras llegó a derivar en lo que Judith Butler, como feminista, como filósofa y como teórica queer, hace con la performatividad. Con este fin se atiende, en primer lugar, a un contexto genealógico en el que confluyen trabajos y discusiones explícitas sobre la performatividad lingüística (como los de Jacques Derrida, Jonathan Culler o Shoshana Felman) junto a la obra de otros autores que, si bien no la tratan explícitamente, ha-cen posible su particular recepción por parte de Butler, como Michel Foucault. En segundo lugar, se trata de entender la reformulación de la performatividad en el ámbito de las identidades sexuales y genéricas, con la que Butler desplaza género y sexo del conjunto de las cosas que somos al orden de las cosas que hacemos. Las relaciones entre cuerpo y lenguaje, materia y textualidad, sexo y género sufren así una transformación con efectos de largo alcance sobre la filosofía, los estudios de género y las políticas identitarias. El intercambio de críticas entre Butler y autores como Seyla Benhabib, Nancy Fraser o Pierre Bourdieu contribuye a entender parte de esos efectos, y también a profundizar en algunas de las prioridades políticas de nuestra autora: la resistencia a los efectos excluyentes de la normatividad genérica y, en particular, del sistema «dos sexos, dos géneros», en dirección a una versión más abierta, inclusiva y proliferante de la identidad. Organizados en tres secciones que dialogan mientras se alejan entre sí, en espiral, los ensayos aquí reunidos cubren un arco temporal que se remonta a los orígenes de los estudios queer, durante los primeros años de la crisis del VIH, y alcanza a la pandemia de Covid-19. El resultado es un libro concebido como un viaje entre pandemias, durante el cual la propia noción de estudios queer se ve afectada, desbordada y, en última instancia, deslocalizada, en (...) su relación con un heterogéneo conjunto de frentes críticos. Quien busque en él la famosa “agenda queer”, no la encontrará. En su lugar, encontrarán motivos para la reflexión crítica quienes, ante los excesos del dogmatismo, prefieran optar por el valor transformador del disenso. (shrink)

En el presente texto se defenderá la idea según la cual, la filosofía y el filosofar están intrínsecamente ligados. Se partirá de un caso paradigmático, el caso de la filosofía analítica. A partir de su definición,se pretenderá mostrar que las características más sobresalientes de dicha corriente están fundamentalmente ligadas al acto de filosofar.Por medio de dicho ejemplo, se desea mostrar que enseñar la filosofía consiste en enseñar a filosofar, y que por lo tanto una no puede ser separada de la (...) otra. Aprender a filosofar es entonces, aprender a ver un problema detrás de cada página de un texto filosófico, una argumentación detrás de cada problema y finalmente, una verdad detrás de cada argumentación. El precio a pagar por dicha separación es bastante alto, se podría hablar de épocas de decadencia intelectual. (shrink)

In this paper we discuss whether the thesis of Nietzsche’s perspectivism, from an interpretation, could be read in keys of onto-epistemological pluralism. For this, we begin by exposing Nietzsche’s questioning of the notion of rational truth, as well as the universalist and transcendental positions linked to this concept. In the second section we expose some of the main theses of American pragmatism and show that perspectivism is not close to this current of thought. Finally, we present the proposal of ontological (...) and epistemological pluralism and we refer to why Nietzsche’s perspectivism could be articulated with this position and why not. (shrink)

I defend the hypothesis that the semantic paradoxes, the paradoxes about collections, and the sorites paradoxes, are all paradoxes of reference fixing: they show that certain conventionally adopted and otherwise functional reference-fixing principles cannot provide consistent assignments of reference to certain relevant expressions in paradoxical cases. I note that the hypothesis has interesting implications concerning the idea of a unified account of the semantic, collection and sorites paradoxes, as well as about the explanation of their “recalcitrance”. I also note that (...) it does not necessarily imply that one should not expect the sometimes hoped for “unique” solution to a paradox of these kinds. (shrink)
